DRIVIN ("we," "our," or "us") is committed to protecting your privacy. This Privacy Policy explains how your personal information is collected, used, and disclosed by DRIVIN.

This Privacy Policy applies to our application and its associated subdomains (collectively, our "SERVICE"), along with our application, DRIVIN. By accessing or using our Service, you acknowledge that you have read, understood, and agree to the collection, storage, use, and disclosure of your personal information as described in this Privacy Policy and in our Terms of Service.

Definitions and Key Terms

To help explain this Privacy Policy as clearly as possible, each time these terms are mentioned, they are strictly defined as follows:

  • Cookie: A small amount of data generated by a website and stored by your browser. It is used to identify your browser, provide analytics, and remember information about you such as your language preferences or login information.
  • Company: When this policy mentions “Company,” “we,” “us,” or “our,” it refers to Drivin SpA (Félix de Amesti 157, Las Condes), which is responsible for your information under this Privacy Policy.
  • Country: Where DRIVIN or its owners/founders are based — in this case, Chile.
  • Client: Refers to the company, organization, or person who registers to use DRIVIN’s Service to manage relationships with its consumers or service users.
  • Device: Any Internet-connected device such as a phone, tablet, computer, or any other device that can be used to visit Drivin and use the services.
  • IP: Every device connected to the Internet is assigned a number known as an Internet Protocol (IP) address. These numbers are usually assigned in geographic blocks and can be used to identify the location from which a device connects to the Internet.
  • Personnel: Refers to individuals employed by DRIVIN or under contract to perform a service on behalf of one of the parties.
  • Personnel Data: Any information that directly or indirectly allows the identification of a natural person.
  • Service: Refers to the service provided by DRIVIN as described in the relevant terms (if available) and on this platform.
  • Third-Party Service: Refers to advertisers, contest sponsors, promotional and marketing partners, and others who provide content or whose products or services may be of interest to you.
  • Application: The DRIVIN application, referring to the SOFTWARE identified above.
  • You: The person or entity registered with DRIVIN to use the Services.

What Information Do We Collect?

We collect information from you when you visit our application, register on our site, place an order, subscribe to our newsletter, respond to a survey, or fill out a form.

Information collected:

  • Name/Username
  • Phone numbers
  • Email addresses
  • Postal addresses
  • Passwords

We also collect mobile device information for a better user experience, although these features are completely optional:

  • Location (GPS): Location data helps create an accurate representation of your interests and may be used to deliver more targeted and relevant ads to potential customers.
  • Camera (Images): Granting camera permissions allows the user to upload any image directly from the platform. You can safely deny camera permissions for this platform.
  • Photo Gallery (Images): Granting access to the photo gallery allows the user to upload images from their gallery. You can safely deny access to the gallery for this platform.

When Does DRIVIN Use End-User Information from Third Parties?

DRIVIN collects End-User Data necessary to provide DRIVIN services to our clients. End users may voluntarily provide us with information they have made available on social networking websites. If you provide us with such information, we may collect publicly available data from the social networking sites you have indicated. You can control how much of your information social networking sites make public by visiting those sites and adjusting your privacy settings.

When Does DRIVIN Use Client Information from Third Parties?

We receive certain information from third parties when you communicate with us. For example, when you submit your email address to express interest in becoming a DRIVIN client, we receive information from a third party that provides automated fraud detection services to DRIVIN. We also occasionally collect publicly available information from social networking websites. You can control how much of your information is made public by visiting those websites and adjusting your privacy settings.

Do We Share the Information We Collect with Third Parties?

We may share the information we collect, both personal and non-personal, with third parties such as advertisers, contest sponsors, promotional and marketing partners, and others who provide our content or whose products or services we believe may interest you. We may also share it with our current and future affiliated companies and business partners. If we are involved in a merger, asset sale, or other business reorganization, we may also share or transfer your personal and non-personal information to our successors.

We may engage trusted third-party service providers to perform functions and provide services on our behalf, such as hosting and maintaining our servers and application, database storage and management, email management, marketing storage, credit card processing, customer service, and order management for products and services you may purchase through the application. We may share your personal information, and possibly non-personal information as well, with these third parties to enable them to provide such services to us and to you.

We may share parts of our log files, including IP addresses, with third parties such as web analytics partners, app developers, and ad networks for analytics purposes. If your IP address is shared, it may be used to estimate general location and other technical data such as connection speed, whether you have visited the application from a shared location, and the type of device used to access the application. They may aggregate information about our advertising and what you see on the application to provide audits, research, and reports to us and our advertisers.

We may also disclose your personal and non-personal information to government officials, law enforcement authorities, or private parties when, in our sole discretion, we believe it is necessary or appropriate to respond to claims, legal processes (including subpoenas), protect our rights and interests or those of a third party, public safety, or to prevent or stop any illegal, unethical, or legally actionable activity, or to comply with court orders, laws, rules, and regulations.

Where and When Is Client and End-User Information Collected?

DRIVIN collects the personal information you provide to us. We may also receive personal information about you from third parties as described above.

How Do We Use the Information We Collect?

Any of the information we collect from you may be used in one of the following ways:

  • To personalize your experience (your information helps us better respond to your individual needs).
  • To improve our application (we continually strive to improve our offerings based on the information and feedback we receive from you).
  • To improve customer service (your information helps us respond more effectively to your customer service requests and support needs).
  • To process transactions.
  • To administer a contest, promotion, survey, or other site feature.
  • To send periodic emails.

How Do We Use Your Email Address?

By submitting your email address on this application, you agree to receive emails from us. You can unsubscribe from any of these email lists at any time by clicking the unsubscribe link or other opt-out option included in the corresponding email. We only send emails to people who have authorized us to contact them, either directly or through a third party. We do not send unsolicited commercial emails, as we dislike spam as much as you do.

By submitting your email address, you also agree that we may use it for customer audience targeting on sites like Facebook, where we display personalized advertising to people who have opted to receive our communications. Email addresses submitted through the order processing page will be used solely to send you information and updates related to your order. However, if you have provided the same email address through another method, we may use it for any of the purposes mentioned in this policy.

Nota: If at any time you wish to stop receiving future emails, we include detailed unsubscribe instructions at the bottom of each email.

How Long Do We Retain Your Information?

We retain your information only as long as necessary to provide you with the DRIVIN service and to fulfill the purposes described in this policy. This also applies to anyone with whom we share your information and who performs services on our behalf. When we no longer need to use your information and there is no need to retain it to comply with our legal or regulatory obligations, we will remove it from our systems or anonymize it so that it cannot be identified.

How Do We Protect Your Information?

We implement a variety of security measures to maintain the safety of your personal information when you place an order or enter, submit, or access your personal information. We offer the use of a secure server. All sensitive and payment information provided is transmitted via Secure Socket Layer (SSL) technology and then encrypted in our payment gateway providers’ databases to be accessible only by those authorized with special access rights to such systems, who are required to keep the information confidential.

After a transaction, your private information (credit cards, social security numbers, financial data, etc.) is never stored on our servers. However, we cannot guarantee the absolute security of the information you transmit to DRIVIN nor ensure that your information on the Service will not be accessed, disclosed, altered, or destroyed due to a breach of our physical, technical, or administrative safeguards.

 

Could My Information Be Transferred to Other Countries?

DRIVIN is incorporated in Chile. Information collected through our application, through direct interactions with you, or through the use of our support services may occasionally be transferred to our offices or personnel, or to third parties located around the world. Your information may be viewed and hosted anywhere in the world, including countries that may not have general laws regulating the use and transfer of such data. To the fullest extent permitted by applicable law, by using any of the mentioned services, you voluntarily consent to the cross-border transfer and hosting of such information.

Is the Information Collected Through the DRIVIN Service Secure?

We take precautions to protect the security of your information. We have physical, electronic, and administrative procedures in place to help safeguard, prevent unauthorized access, maintain data security, and use your information correctly. However, no individual or security system is infallible, including encryption systems. Additionally, individuals may commit intentional crimes, make mistakes, or fail to follow established policies. Therefore, although we make reasonable efforts to protect your personal information, we cannot guarantee its absolute security. If applicable law imposes a non-waivable duty to protect your personal information, you agree that intentional misconduct shall be the standard used to measure our compliance with that duty.

Can I Update or Correct My Information?

The rights you have to request updates or corrections to the information DRIVIN collects depend on your relationship with DRIVIN. Personnel may update or correct their information as detailed in our internal employment policies.

Clients have the right to request restrictions on certain uses and disclosures of personally identifiable information as follows. You may contact us to: (1) update or correct your personally identifiable information, (2) change your preferences regarding communications and other information you receive from us, or (3) delete personally identifiable information maintained on our systems (subject to the paragraph below) by canceling your account. Such updates, corrections, changes, and deletions will not affect other information we maintain or have provided to third parties in accordance with this Privacy Policy prior to such update, correction, change, or deletion.

To protect your privacy and security, we may take reasonable steps (such as requesting a unique password) to verify your identity before granting access to your profile or making corrections. You are responsible for maintaining the confidentiality of your password and account information at all times.

Please note that it is not technically possible to remove every record of the information you have provided from our systems. The need to back up our systems to protect information against accidental loss means that a copy of your information may exist in a non-erasable form that will be difficult or impossible to locate. As soon as we receive your request, all personal information stored in databases we actively use and in other readily accessible media will be updated, corrected, changed, or deleted as appropriate, as soon as reasonably and technically feasible.

If you are an end user and wish to update, delete, or receive any information we have about you, you may do so by contacting the organization of which you are a client.

Personnel

If you are a worker or job applicant at DRIVIN, we collect the information you voluntarily provide. We use the collected information for Human Resources purposes, to manage employee benefits and evaluate applicants.

You may contact us to: (1) update or correct your information, (2) change your preferences regarding communications and other information you receive from us, or (3) receive a record of the information we hold about you. Such updates, corrections, changes, and deletions will not affect other information we maintain or that we have provided to third parties under this Privacy Policy prior to such update, correction, change, or deletion.

Business Sale

We reserve the right to transfer information to a third party in the event of a sale, merger, or other transfer of all or substantially all of DRIVIN’s or any of its corporate affiliates’ assets (as defined in this Privacy Policy), or in the event we cease operations or file, or have filed against us, a petition for bankruptcy, reorganization, or similar proceeding, provided that the third party agrees to comply with the terms of this Privacy Policy.

Affiliates

We may disclose information (including personal information) about you to our corporate affiliates. For purposes of this Privacy Policy, a “Corporate Affiliate” means any person or entity that directly or indirectly controls, is controlled by, or is under common control with DRIVIN, whether by ownership or otherwise. Any information related to you that we provide to our corporate affiliates will be treated by those affiliates in accordance with the terms of this Privacy Policy.

Governing Law

This Privacy Policy is governed by the laws of Chile, without regard to its conflict of law provisions. You agree to the exclusive jurisdiction of the courts in relation to any action or dispute arising between the parties under or in connection with this Privacy Policy, except for individuals who may have rights to bring claims under the Privacy Shield framework or the Swiss–U.S. agreement.

The laws of Chile, excluding its conflict-of-law rules, shall govern this Agreement and your use of the application. Your use of the application may also be subject to other local, state, national, or international laws.

By using DRIVIN or contacting us directly, you express your acceptance of this Privacy Policy. If you do not agree with this Privacy Policy, you should not interact with our application or use our services. Continued use of the application, direct contact with us, or acceptance of changes to this Privacy Policy that do not significantly affect the use or disclosure of your personal information shall constitute your acceptance of such changes.

Your Consent

We have updated our Privacy Policy to give you full transparency about what data is collected when you visit our site and how it is used. By using DRIVIN, registering an account, or making a purchase, you agree to our Privacy Policy and its terms.

Links to Other Websites

This Privacy Policy applies only to DRIVIN’s Services. The Services may contain links to other websites not operated or controlled by DRIVIN. We are not responsible for the content, accuracy, or opinions expressed on such websites, nor do we investigate, monitor, or verify their accuracy or completeness. Please remember that when you use a link to leave our Services for another website, our Privacy Policy no longer applies. Your browsing and interaction on any other website, including those linked on our platform, are subject to that website’s own rules and privacy policies. These third parties may use their own cookies or other methods to collect information about you.

Cookies

DRIVIN uses "Cookies" to identify the areas of our application you have visited. A cookie is a small piece of data stored on your computer or mobile device by your web browser. We use cookies to improve the performance and functionality of our application, but they are not essential for its use. However, without these cookies, certain functionalities, such as video playback, may not be available, or you may need to enter your login details every time you visit the application, as we would not be able to remember that you have already logged in. Most web browsers can be configured to disable the use of cookies. However, if you disable cookies, you may not be able to access certain functions of our application properly or at all. We never store personally identifiable information in cookies.

Blocking and Disabling Cookies and Similar Technologies

Regardless of your location, you can configure your browser to block cookies and similar technologies, but this action may block our essential cookies and prevent our application from functioning properly, which could prevent you from using all its features and services. You should also note that if you block cookies in your browser, you may lose saved information (e.g., login data or site preferences). Different browsers offer different controls for managing cookies. Disabling a cookie or a category of cookies does not delete the cookie from your browser; you must do this yourself from your browser settings. For more information, please refer to your browser’s help menu.

Children’s Privacy

We do not direct our services to individuals under 13 years of age. We do not knowingly collect personally identifiable information from anyone under 13. If you are a parent or guardian and are aware that your child has provided us with Personal Data, please contact us. If we discover that we have collected Personal Data from a child under 13 without verified parental consent, we will take steps to delete that information from our servers.

Changes to Our Privacy Policy

We may modify our Services and policies, and we may need to update this Privacy Policy to accurately reflect those changes. Unless otherwise required by law, we will notify you (for example, through our Service) before making changes to this Privacy Policy and give you an opportunity to review them before they take effect. If you continue to use the Service after the changes take effect, you will be bound by the updated Privacy Policy. If you do not agree with this or any updated Privacy Policy, you may delete your account.

Third-Party Services

We may display, include, or make available third-party content (including data, information, applications, and other products or services) or provide links to third-party websites or services (“Third-Party Services”).

You acknowledge and agree that DRIVIN shall not be responsible for any Third-Party Services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality, or any other aspect thereof. DRIVIN does not assume and shall have no liability or responsibility to you or any other person or entity for any Third-Party Services.

Third-Party Services and their links are provided solely for your convenience, and you access and use them at your own risk, subject to such third parties’ terms and conditions.

Tracking Technologies

Google Maps API

Google Maps API is a robust tool that can be used to create a custom map, a map with search functions, registration features, live data visualization synchronized with location, route planning, or creating map combinations, among other uses. Google Maps API may collect information from you and your device for security purposes. Google Maps API collects information in accordance with its own Privacy Policy.

Cookies

We use cookies to improve the performance and functionality of our platform, although they are not essential for its use. However, without these cookies, certain functionalities, such as video playback, may not be available, or you may need to enter your login details each time you visit the platform, as we would not be able to remember that you have already logged in.

Local Storage

Local storage, also known as DOM storage, provides web applications with methods and protocols to store data on the client side. This storage allows for persistent data retention, similar to cookies, but with significantly greater capacity and without the information being stored in an HTTP request header.

Sessions

We use “Sessions” to identify the areas of our platform you have visited. A session is a small piece of data stored on your computer or mobile device by your web browser.

Information About the General Data Protection Regulation (GDPR)

We may collect and use information from you if you are located in the European Economic Area (EEA). In this section of our Privacy Policy, we explain exactly how and why this data is collected, as well as the measures we take to protect it and prevent misuse.

What is the GDPR?

The General Data Protection Regulation (GDPR) is a privacy and data protection law applicable throughout the European Union that governs how companies protect the data of EU residents and gives them greater control over their personal information.

The GDPR is relevant for any globally operating company, not only those based in the EU or dealing with EU residents. The privacy of our customers’ data is important regardless of where they are located, which is why we have implemented GDPR controls as our baseline standard across all our global operations.

What is Personal Data?

Any data that allows a person to be identified directly or indirectly. The GDPR covers a broad spectrum of information that, alone or in combination with other data, can be used to identify an individual. Personal data includes more than just names or email addresses. Examples include financial information, political opinions, genetic data, biometric data, IP addresses, physical addresses, sexual orientation, and ethnic origin.

Data Protection Principles

The GDPR establishes key requirements such as:

  • Personal data must be processed fairly, lawfully, and transparently, and used only in ways that a reasonable person would expect.
  • Personal data must be collected for a specific purpose and used only for that purpose. Organizations must specify the reason for collecting personal data at the time of collection.
  • Personal data must not be retained longer than necessary to fulfill its purpose.
  • Individuals covered by the GDPR have the right to access their personal data. They may also request copies of their data and demand that it be updated, deleted, restricted, or transferred to another organization.

Importance of the GDPR

The GDPR introduces new requirements on how companies must protect the personal data of individuals they collect and process. It also strengthens compliance by increasing oversight and imposing stricter penalties for noncompliance. Beyond these legal aspects, it is simply the right thing to do. At DRIVIN, we firmly believe that the privacy of your data is very important, and we already have strong security and privacy practices that go beyond the requirements of this regulation.

Data Subject Rights: Access, Portability, and Deletion

We are committed to helping our clients comply with the GDPR’s data subject rights requirements. DRIVIN processes or stores all personal data in fully verified, data-protection-compliant providers. We retain all conversations and personal data for up to six years, unless you delete your account. In that case, we will delete all information in accordance with our Terms of Service and Privacy Policy, retaining it no longer than 60 days.

We recognize that if you work with EU customers, you must provide them with the ability to access, update, retrieve, and delete personal data. We’ve got you covered! From the start, we designed our system as self-service, giving you access to your data and your clients’ data. Additionally, our support team is available to answer any questions you may have about using our API.

California Consumer Privacy Act (CCPA) Rights

The California Consumer Privacy Act (CCPA) requires us to disclose the categories of personal information we collect, how we use it, the sources from which we obtain it, and the third parties with whom we share it, as previously explained.

We must also inform you of the privacy rights granted to California residents under state law. You may exercise the following rights:

  • Right to Know and Access: You may submit a verifiable request to obtain information about: (1) the categories of personal information we collect, use, or share; (2) the purposes for which we collect or use such information; (3) the sources from which we obtain personal information; and (4) the specific data we have collected about you.
  • Right to Equal Service: We will not discriminate against you for exercising your privacy rights.
  • Right to Delete: You may submit a verifiable request to close your account, and we will delete the personal information we have collected about you.
  • Right to Opt-Out of the Sale of Information: You may request that we do not sell your personal data. However, we do not sell users’ personal information.

If you submit a request, we have one month to respond. If you wish to exercise any of these rights, please contact us.

California Online Privacy Protection Act (CalOPPA)

CalOPPA requires us to disclose the categories of personal information we collect, how we use it, the sources from which we obtain it, and the third parties with whom we share it, as previously explained.

CalOPPA users have the following rights:

  • Right to Know and Access: You may submit a verifiable request to obtain information about: (1) the categories of personal information we collect, use, or share; (2) the purposes for which we collect or use such information; (3) the sources from which we obtain personal information; and (4) the specific data we have collected about you.
